  • File Form I-140 (Immigrant Petition for Alien Workers) The process begins by submitting Form I-140, which officially petitions for your eligibility under the EB-2 National Interest Waiver category.   • Prepare and Organize Supporting Evidence You will need to provide documentation that satisfies the three main criteria from the Matter of Dhanasar decision, which USCIS uses to evaluate NIW petitions:
  1. Your proposed work has substantial merit and national importance.
  2. You are well-positioned to advance that work.
  3. Granting the waiver would benefit the United States, making a job offer and labor certification unnecessary.
  • Obtain Strong Recommendation Letters. Letters of recommendation from independent professionals or recognized experts in your field are highly valuable.
